Warehouse, Trucking, And The Work That Moves Freight

If you work a warehouse floor or a loading dock, you already know how people get hurt. Lifting that wrecks backs and shoulders. Forklift accidents. Falls from docks and ladders. Thousands of identical motions a shift, and heat in buildings that never cool down. Drivers get hurt on the road and during loading and unloading. Factory floors, food plants, and service bays are the same story, with machines, crush injuries, cuts, chemicals, and noise. Transportation and warehousing are two of the biggest sources of workplace injuries in California ( U.S. Bureau of Labor Statistics). These kinds of workers' compensation claims are the heart of our practice. If the work did it to you, it may be a claim. Lifting and repetitive warehouse work can cause injuries that build up over time. How the date of injury works when you file a claim →

The Lies El Monte Workers Get Told

Did the insurer deny your warehouse or delivery injury claim? How to challenge a denied claim →

"You're a temp, so you're not covered." Wrong. Staffing-agency and temp workers are covered like anyone else ( California Division of Workers' Compensation).

"You're paid in cash, so there's no claim." Wrong. How you're paid doesn't erase your rights.

"Your immigration status disqualifies you." Wrong. California workers' comp doesn't ask.

"They'll fire you if you file." Illegal. Your employer cannot fire or punish you for filing a claim, and retaliation gives you more claims, not fewer rights.

And one more. If your employer never bought workers' comp insurance at all, which is illegal, that situation makes a lawyer more important, not less. None of these is a reason to stay quiet. The only thing that can genuinely kill a good claim is waiting. Report the injury to your employer within 30 days. If your claim is disputed, you generally have one year to file with the Workers' Compensation Appeals Board, counted from the latest of your injury date, your last disability payment, or your last medical treatment. Exceptions exist, so act early.

What A Claim Actually Gets You

Your medical treatment, paid for. Wage-replacement checks while you can't work. Money for permanent damage if the injury leaves lasting harm. Retraining help if you can't go back to the old job. And for families who lose someone, death benefits. The lawyer costs you nothing up front. Fees come out of the recovery under amounts the state approves, and the consultation is free, in English or Spanish.
